COALITION OF MOBILEHOME OWNERS - CALIFORNIA

THE THREATS

Proposition 90 is back as the "California Property Owners and Farmland Protection Act" or CPOFPA.   The State Attorney General has given this fourth and  final version of the Jarvis Tax Committee eminent domain initiative a title and summary.  This initiative will eliminate rent control.

Now designated Proposition 98, voters will say Yes or No on June 3rd 2008.  Since the June election will likely one with very low turnout, it is very important that you tell all your voting age friends and neighbors to get out and VOTE NO on this new threat to rent control.

The League of California Cities has introduced a counter "eminent domain" initiative, # 99.  It deals with eminent domain, but leaves rent control untouched.  CoMO-CAL strongly urges you to vote YES on Proposition 99.


Today, rent control extends to about 105 cities and counties with  approximately 150,000 spaces or three quarters of a million residents.  If Proposition 98 passes, this could mean an average rent increase of $500/month.  This translates into an equity loss/space of about $50,000.  Eventually every resident now under rent control will be affected resulting in an equity loss of $7.5 billion!!!   This is a staggering amount.  

Do you know that some residents here in Los Angeles County have lost their mobilehomes to the park? They had to walk away from their homes and received nothing in return.  You think they must have done something very wrong, but that is usually not the case.  In one instance a home owner did not respond to a three day pay or quit notice.  He incorrectly thought he could pay two months and a late charge when next months rent was due. The park wouldn't accept his payment and ultimately it cost the man his home.  This could happen to you if you do not have anyone to turn to or if you do not understand the law yourself. 

Do you know that with a group of about 30 residents in a park in Long Beach won a “failure to maintain” lawsuit for $4,600,000. against their park.  Some residents were awarded as much as $55,000. and got a new management company, one that is known state-wide as a management company that cares about the residents.

Do you know that the Los Angeles Housing Department has a Mobile Home Park Task Force and some of its members represent you if you own a  mobilehome in the City of Los Angeles?

Do you know there is a campaign in some parks to remove the vast majority of older mobilehomes using whatever means necessary to regain their lot spaces?  Do you know this is a violation of the law? 

Do you know some parks interfere with sales of mobilehomes?  Sometimes they interfere by not approving a qualified buyer or other means.
